The Website provides general information about CreatorX and its talent-management, brand-partnership, consulting, and related services. Website content is provided for informational purposes only and may be changed or removed at any time.

Nothing on the Website constitutes legal, financial, employment, or other professional advice.

2. Eligibility

You must be at least 18 years old and legally capable of entering into an agreement to use the Website. If you use the Website on behalf of a company or another person, you represent that you have authority to bind that party to these Terms.

3. No Representation or Business Relationship

Your use of the Website, submission of an inquiry or application, or communication with CreatorX does not create a talent-management, agency, employment, partnership, fiduciary, or other business relationship.

CreatorX represents talent and performs services only under a separate written agreement signed by the applicable parties. We have no obligation to review, respond to, accept, or retain any submission.

4. Submissions and Communications

If you submit information, materials, content, proposals, portfolios, social media profiles, or other communications through the Website, you represent that:

  • The information is accurate and not misleading;
  • You have the right to provide the submitted materials;
  • The submission does not violate another person’s rights; and
  • The submission does not contain unlawful, harmful, or malicious material.

Unless we have separately agreed otherwise in writing, submissions will not be treated as confidential or proprietary. You should not submit trade secrets or other sensitive confidential information through the Website.

You grant CreatorX a limited, nonexclusive right to access, review, reproduce, and internally share submitted materials for the purpose of evaluating and responding to your inquiry or potential business relationship.

The appearance of talent or a brand on the Website does not necessarily indicate a current relationship, endorsement, or availability. Past work and examples do not guarantee future results.

The Website may link to third-party websites, social media platforms, or services. CreatorX does not control and is not responsible for their content, availability, security, or privacy practices.

Links are provided for convenience and do not necessarily constitute an endorsement. Your use of third-party services is governed by their own terms and policies.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Website is provided “as is” and “as available,” without warranties of any kind, express or implied.

CreatorX does not warrant that the Website will be uninterrupted, error-free, secure, accurate, complete, or free of viruses or harmful components. We do not guarantee any particular result from using the Website or contacting CreatorX.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

10. Limitation of Liability

To the fullest extent permitted by law, CreatorX and its owners, officers, employees, contractors, representatives, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the Website or these Terms.

To the fullest extent permitted by law, CreatorX’s total liability for any claim relating to the Website or these Terms will not exceed one hundred U.S. dollars ($100).

These limitations apply regardless of the legal theory asserted and even if CreatorX has been advised that damages are possible. Nothing in these Terms excludes liability that cannot legally be excluded.

11. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless CreatorX and its owners, officers, employees, contractors, representatives, and affiliates from claims, liabilities, damages, losses, and reasonable expenses arising from:

  • Your misuse of the Website;
  • Your violation of these Terms;
  • Materials or information you submit; or
  • Your violation of another person’s rights or applicable law.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Before filing a legal claim relating to the Website, you agree to provide CreatorX with written notice describing the dispute and allow 30 days for the parties to attempt an informal resolution.

Any legal action that is not resolved informally must be brought exclusively in the state or federal courts located in Los Angeles County, California. You and CreatorX consent to the jurisdiction and venue of those courts.

13. Changes to the Website or Terms

We may modify, suspend, or discontinue any part of the Website at any time.

We may also update these Terms periodically. Updated Terms will be posted on the Website with a revised effective date. Your continued use of the Website after updated Terms are posted constitutes acceptance of those changes.

CreatorX’s failure to enforce any provision of these Terms does not waive its right to enforce that or any other provision later.

These Terms and the Privacy Policy constitute the entire agreement between you and CreatorX concerning use of the Website. They do not replace or modify any separately signed agreement between CreatorX and a creator, client, vendor, employee, or other party.
